Rates normally vary according to the source and target languages, the technicality of the text, the purpose and the urgency of the translation. RST has a right to provide a different price assessment each time.
Verbal price estimates are provided for guidance only. Quotations made without sight of text are subject to amendment at any time after having received the document(s) for review. Normally quotations must be accepted in writing before work is undertaken. Written quotations remain valid for 30 days after delivery.
RST agrees that neither it nor its subcontractors (translators, interpreters, proofreaders, voice-over artists and other personnel) will disclose to any third party, without the prior written consent of a Client, any information relating to the business of a Client, the customers and clients of the Client, if such information could reasonably be construed as confidential and was obtained in the course of RST providing services on Client’s project.
- 4.1 Translations: Quotations are provided on the number of words in the source language or the estimated number of words in the target language in case the source language word count cannot be carried out.
- 4.2 Charges for foreign language typing and word processing are based on the number of words.
- 4.3 Modifications after initial quotation, e.g., additions, amendments, variations, editing, retyping shall incur a surcharge added to the original quotation.
- 4.4 Translation of formulae, table formatting, number rewriting, drawings, conversions, etc. is charged by the hour or by volume whichever is the higher.
- 4.5 The revision / proofreading of already translated documents is charged by the hour or by volume whichever is the higher.
- 4.6 All interpreting assignments are charged per hour rate (minimum fee for three hours) as well as overtime, travelling and accommodation costs, travel time costs.
- 4.7 Telephone calls to foreign customers on the client’s behalf are charged at a minimum rate plus cost of call.
Surcharges may be charged at RST discretion; however in general terms will apply:
- 5.1 For poor quality source or hand-written text an extra charge of 25%.
- 5.2 Where work is to be used for publication and additional formatting, typesetting (DTP) etc. services are required, they will be charged separately per page or per hour whichever is higher.
- 5.3 For urgent delivery a surcharge of 25 % may be applied.
- 5.4 For deliveries by post other than standard or 1st class delivery in the UK.
- 5.5 Costs for delivery by fax outside the UK or of over 5 pages within the UK.
All private persons are requested to make the payment in full before the work is started.
All other first time customers may be requested to make the payment in full prior to the commencement of the work.
Payments can be made by one of aforementioned methods: bank transfer to pound sterling account, UK GBP sterling cheque, Moneybookers, Paypal or secure online payment method by credit / debit card (we will send you a link to pay or you can pay by debit / credit card on the phone).
Where credit accounts are opened for regular Clients, payment must be made within 30 days of the date of the issued invoice.
In case of delayed payments, 5% interest of the amount due per 1 week period or part thereof or £20, whichever is the greater, will be made on all accounts outstanding beyond the due date to cover financial and administrative costs and will be added to those accounts. All work in progress and all orders in progress shall be suspended either temporarily or permanently in the event of late payment
7. PURPOSE OF TRANSLATED DOCUMENTS
- 7.1 A Client shall clearly indicate in writing the purpose of the translation it will be used for.
- 7.2 RST shall not be held liable for any reason whatsoever for translations which are not stylistically satisfactory. Particularly for advertising and promotional material, the services of RST shall be limited to simple translation, unless expressly requested. Unless otherwise requested in writing a translation is undertaken for information and understanding only, which is of a high enough standard for use in general correspondence. RST shall not be liable for drafting the translated text in, for example, an advertising style that is different from the source text. Our liability shall be limited to the amount of the invoice.
- 7.3 Should a Client wish to use a translation or other performed work by RST for any other purpose than that for which it was originally advised, the Client shall obtain written confirmation from RST that the performed work is suitable for the intended new purpose. RST reserves the right to amend and adapt, at the cost of the customer, the previously supplied translation, if necessary, for the new purpose.
- 7.4 Where the purpose of the translation is not disclosed to RST, RST shall execute the translation as if it were for information only.
If the Client cancels the confirmed work in writing, 25% of the total fee shall be levied by RST.
If work has already commenced the client shall reimburse RST for the cost of such work together with a cancellation charge of 25% of the original quotation (as amended).
The interpreting assignments confirmed in writing by the Client and cancelled within 1 day from the confirmation shall incur a £ 50 cancellation fee. Any other confirmed and cancelled interpreting assignments after more than 1 day from the written confirmation date shall be reimbursed by the Client at the rate of 25% or £ 50, whichever is higher.
Delivery is deemed to have taken place on sending the translation by e-mail, faxing, posting or delivery to a carrier, post office as appropriate, and the risk shall pass to the Client.
A delivery date agreed in writing between RST and the Client shall be binding on RST only where such date was confirmed by RST after having received all the documents for translation without subsequent additions or amendments by the Client.
In the event of the loss or damage of the translated documents, RST will retain a copy of the translation and will forward a further copy by e-mail fax, standard or 1st class post within the UK free of charge.
Although an urgency surcharge may be levied on urgent work, because of restricted time to perform works of high quality and accuracy, RST will not accept any liability for any work submitted on an urgent basis.
Complaints shall only be taken into consideration if received in written form by recorded post within seven days of delivery of the job(s) or part of the job(s).
All complaints must be accompanied by the original documents, disputed translations, and a letter of explanation.
Once the above time period has elapsed, the translation shall be considered correct.
In the event of an unsatisfied client where a complaint is made within the established deadlines, RST agrees, at its own expense, to deliver an edited version of the disputed translation within a reasonable timeframe.
This second document shall be used to judge the quality of the translation in order to establish the amount of reimbursement, at RST own discretion.
12. FORCE MAJEURE
In case of Force Majeure (Natural Disaster, Strike, Industrial Dispute, Lockout, Acts of War and any other situation which can be proven to have materially affected the Company’s ability to deal with the order from the Client) the Company or its Agents shall notify the Client without delay, indicating the circumstances.
Force Majeure shall entitle both the Company and the Client to cancel the order but, in any event, the Client undertakes to pay the Company for work already completed.
The Copyright of the translation is the property of RST and will be passed on to the Client only after full payment has been received for the translation.
The Client guarantees that the required translation does not infringe any copyright or other proprietary right and shall indemnify the Company and its Agents in respect of all actions, claims, proceedings, costs and damages incurred or awarded and paid in respect of, or arising out of, any breach of such warranty or out of any claim by a third party based on any facts which, if substantiated, would constitute a breach of such warranty.
14. CODE OF ETHICS
Following the Code of Ethics of the Institute of Linguists and the Institute of Translators and Interpreters, any communication of any kind between the Client and the actual translator / interpreter is strictly forbidden without RST prior written permission.
RST holds a professional indemnity insurance against translation errors.
RST undertakes to provide the translation or other services to the best professional standard.
Since the translation or interpreting assignment is a subjective process, therefore the meaning can be conveyed in more than one equally correct way.
RST will deliver an accurate translation but shall not be liable for such variations.In case of the preferred company and industry related terminology to be used in translation as requested by the Client, RST will attempt to utilise the glossaries, reference material, previous translations submitted by the client.
RST and/or related suppliers shall not be liable, for any reason whatsoever, for special, indirect or consequential damages or for any other damages of any type resulting from the loss of rights to use, loss of information or lost profits, whether they result from performance of the contract, negligence or other detrimental actions, deriving from or in some way connected with the services of RST.
17. SETTLEMENT OF DISPUTES
The Parties should make efforts to settle disputes in friendly manner, but failing that disputes between the Client and the Company shall be settled by arbitration.
The decision of the Arbitration Tribunal shall be binding on all parties involved and shall be final. Arbitration shall be conducted in accordance with the Arbitration Act 1950.
18. GOVERNING LAW
The above set conditions and all other contractual relationships and disputes relating thereto between the Client and RST shall be governed by laws and courts of England.
By confirming this agreement by e-mail, fax or any other written form, the Client accepts all provisions, terms and conditions of this contract set forth above and acknowledges that it is sole responsibility of the Client to make full payment of all charges and costs relating to the project within the agreed time stated on the invoice from the date of the invoice or in advance (applied for private customers).
The payment to RST by the Client shall not be affected in any way whatsoever in case of Client’s failure to collect the project related payments from the third party.
